Can self-managed condo association evict owners?


Question:

All purchasing owners signed a Condominium Owner Power of Attorney back in 1995. Can current Board (we're small self-managed), initiate eviction process against unauthorized occupants in one of our 13 units. Owner abandoned unit in January 2013, due to defaulting on mortgage and delinquency of common charges. Bank had assigned mortgage to FNMA prior obtaining Foreclosure and Sale. FNMA claims to have no record of Assignment, bank said the no longer have a vested interest in property. Bank also claims to had transferred loan to another servicer, and upon contact the servicer, they too claim not to have record of loan transfer or property. So can current Board use irrevocable POA to initiate eviction process in New York state?
