Condo owner stuck with water damage repair bill


Question:

My neighbor owns the condo upstairs and one unit over from mine. I live in a flat downstairs, and her wall runs down into my condo. She had a busted pipe in the wall which caused damage to my floors and a mildew problem. My neighbor's liability insurance said they are not responsible, because my neighbor was not aware of the busted pipe in the the wall. My Home Owners Association changed the by-laws that states "If the casualty damage is only to those parts of one or more units, for which the responsibility of maintenance and repair is that of the unit owner then such owner shall be responsible for reconstruction and repair after casualty. The responsibility of reconstruction and repair after casualty shall NEVER be that of the association. I need some input on this problem. What happens in a case such as this one. Who repairs my damages? I would appreciate some input. I am an innocent victim, so somebody should be responsible for my damages. Any suggestions?
