Flooring fiasco in Philadelphia condo

not_fair_babyI am renovating my second story condo completely to put it on the market. I checked the bylaws and all rules and regulations and nowhere does it state that I must use carpeting.

After installing a new and much improved sub-structure and a new high grade laminate flooring throughout, including the kitchen, also with extra padding, I received a call from the condo manager that I was in violation and the upper units must be carpeted only.

I told her I would never have bought the unit if I thought I wasn't free to replace with a flooring option. If there is nothing in my bylaws and rules about second floor units being carpeted only, does she have the right to tell me this? Between the special substructure and the new flooring I've already spent well over $10,000 on the flooring for 1100 sq ft.

If I have to rip it out, I would only be able to install the cheapest carpeting and pad and my tenants below would have been better off with the better grade flooring, not to mention the the fact that the price I get for a condo with flooring vice carpet will increase the value of our condos benefiting everyone. Can the condo assn make me do this if its not spelled out in the bylaws, rules/regs, amendments,etc?

I am concerned about my neighbors and I put in the best I could afford so that they would not be inconvenienced, but I have a feeling that it is they who told the condo manager to begin with.

Any suggestions? Even my Realtor, who specializes in selling these condos told me to put in laminate instead of carpeting.

I've seen other second floor condos here with flooring, so why am I being singled out?
