Home Damage: California paint contractor destroys wall. HOA not responding.


Question:

Our HOA Management Co., hired a "paint contractor" who power washed my wall then applied paint to some damp exposed wood from rain on that night. The wood started rotting after one year 

and continues disintegrating due to no follow up for sanding, prepping then painting it. Since the wall was wet the paint ran all over my deck. One month after this was done the Association voted to no longer cover certain things including this mess. I assume legally they must eventually address and fix this problem since it was caused prior to this. My home is the only one that did not have trim painted since they stopped work! What do I do? I've sent registered letters and get an email that the management co. will reply shortly or no reply.

My roof was just done and it is buckling, rippling and lifting which from what info I can find is due to improper installation. I am going to be selling so how can they be forced to finally maintain or fix what they have let deteriorate. Isn't there something about a fiduciary duty, negligence and definitely discrimination? I really could use some information. I would not mind getting an estimate and taking them to small claims court. I may be suing myself but something must be done ASAP or I can't sell!. California
