Illinois board president insists state condo law prevails


Question:

know-it-all-lady-1I have a question about our board, they are proposing a $350,000 loan and pretty much not letting owners, present at the meeting, vote on this proposal. 

The president/Board (of 3 members) are planning to vote amongst themselves. 

Our bylaws state that board requires owners' vote on the matters/expenses in excess of $5,000.  Well, when we questioned our President/Board about this, her [president's] response was "IL Condo Act supersedes this".

And that's not all, the president herself doesn't even reside at the property, her disabled brother does, and she's a Trustee. 

Our bylaws state that to serve on the board, you need to be an owner AND reside at the property. When we brought that up to her, her response, again, is "IL Condo Act supersedes it wherein it states that you only need to be an owner to serve on the Board". 

Is this true? We find it hard to believe that we should not follow our bylaws but instead count on our president that says "IL condo Act supersedes it".
