Internal cracks related to foundation sinking - who pays in MO?


Question:

My mother's condo has internal wall cracks resulting from the common building foundation sinking.

Recently, the board hired structural engineers to fix the foundation and outside cracks. The total cost was shared by the association.

Indentures state homeowners are required to pay for all internal repairs.

Is there an exception in this case to argue that the common foundation issue caused the internal damages?
