Next door neighbor has loud floor and needs to fix it


Question:

My neighbors and I have been tortured for years by loud noise in our units. We just learned that the unit next to mine has a tile floor without the legally required cork underneath, just bare cement. The owner claims she doesn't have to do anything about it because she bought the unit 'as is" in 2001 and had no knowledge of it. And the association's attorney claims there is a five-year statute of limitations. Must we continue to suffer or can we force her to correct the violation?
