Ohio Condo Association questions responsibility of condo unit window repairs

My husband is the President of a 52 unit Ohio Condo Association, which was built in 1973. We are currently faced with leaky window issues in many of the condo units, largely due to settling of the units over the years and poor installation.

The Condo Association has footed this bill in the past. Our Documents currently state that the Condo Association is responsible for the maintenance and upkeep of Common areas and Facilities, while condo owners shall be responsible for the management, maintenance, repairs, alterations and improvements for everything within their units, as well as ‘Limited’ Common areas designated for their use (i.e. decks).

Has our Condo Association been in error in taking responsibility in the past for these repairs? If so, can we now change our Documents and provide an explanation to the condo owners?
