Squirrels and rats in attic - who must fix roof?

rats-in-condo-attic.jpgMy unit is next to a creek. We have a tile roof with no underlying plywood.

In order to fix the problem of squirrels and rats entering my attic, the rodent control will have to block their entrance by screening or blocking their entrance through the curvature of the tiles which meet the roofline. In other words, they will have to make alterations to the roof.

The HOA claims no responsibility. The pests are my problem and my roof to fix. The CC&R's state that the HOA is responsible for roof repair.

Who is right?
