Can condo association put a lien on property over assessment

Can a condo association put a lien on my unit for not having to pay for another set of special assessment fee that they said that we have to pay? I do make my monthly condo fee and one set of special assessment on time. I just cannot afford to pay for another set of assesment. Help!

How do condo associations deal with window replacements?

Our condo has been paying for window replacements. I am not sure this has lead to the best use of funds. I was wondering how other associations deal with this issue. Do owners normally pay for this or does the association? We also are at a point where the current windows are a style that is not energy efficient and we may need to go with a different style. So, my last question is, when choosing a company and window to go with what have been some things that have worked and not worked?

A question that might be of general interest to many condominium unit owners arose during a March 2013 post: Can a lien be put on your property in secret? Can a lien be put on your property without documented notification; which might be 1) being served with a summons to court 2) receiving a certified letter or some other form of communication requiring official receipt. Under the law and under normal practice can an entity put a lien on your condominium unit without telling you? Opinions and comments on past experience would be interesting to this forum.

Do municipalities have authority to assess condo associations?

I live in Homer, Alaska and own a condo in Homer and one in Anchorage. My situation is legal and involves a municipality's power to "assess". It looks like my Homer City Council is "making condo assessment law" which could end up affecting condos in the entire state. Basically, they have assumed the legal position that the 'law' makes them assess each condo unit and fully assess each. For example, two identical lots and buildings. One lot is a ten unit apartment and the other is a ten condo building. Apartments are assessed once....the condos are assessed ten times. Can you help? Looking for a national or statewide organization that recognizes condo owners does not seem to exist.

HOA president buys units cheap then reduces past dues

I am trying to purchase a condo in Fort Myers Florida , in a certain complex. The president keeps buying these cheap units up. He is using his power to give himself reduction in past hoa dues . He buys thens rents them out or flips them . Is this legal? He won't give me any reductions .

Can association demand new buyer pre-pay one year's assessments?

My condo is in Florida. It is now under new management. The unit owners have received a limited proxy to sign to approve new amendments that are necessary to provide the Association to approve sale transactions of our units. One of the new requirements is that the Association will require the prospective purchaser to pre-pay up to one year's worth of assessments which shall be held, interest-free, by the Association and applied to the owner's assessments as they become due and payable. How will they know in the future how many assessments they will need, and therefore, need to charge. Is this a new law?

How/what late fees can a condo association or HOA charge?

We are trying to motivate owners to pay their fees and pay them in time. Can the association charge late fees on: Fines Move in/Move out fees and late fees on late fees? My understanding that we can not file lien for fines and late fees? But should not issue clean certificate 6d. Association is in Massachusetts.

Are assessments for specific repair or maintenance projects?

Do special assessments have to be for a specific common area maintenance project? Our board charged home owners with a $1900 special assessment because 50% of the units were not paying their monthly dues. I have refused to pay this assessment and now I am being sent collection letters stating that they will place a lien on my property. I have requested to see the minutes time and time again to determine the purpose of the assessment but have been ignored. What are my rights?

Does condo board need to present the annual budget at the meeting?

Are the condo board's obligated to present an annual budget to the HOA members at the annual meeting? Does it have to be approved by the members? I can't ever recall one being presented to us, due to the fact that our President always says "the day to day decisions for operating the HOA, is up to the boards". And our by-laws are really vague on a lot of things. It doesn't spell out the term length for our officers, where as the other associations within our development does.
