Is my condo association is overcharging me on a late fee?

Can a late fee be assessed by my condo association if a check was returned by the bank and I was not told until 30 days later and found out the bank made an error and reversed the return check fee? If you are paying the condo fee in advance (quarterly), can they charge 10% of the quarterly fee for late payment after 10 days?

It depends. Was it your bank that made the error or the HOA's bank? If it was your bank, the HOA might say "It's not our problem". If it's the HOA bank, the HOA bank may reimburse, or the HOA may knock off the late charge. Some HOAs are more forgiving than others. What can I say? If it is a sizable amount, it might be worth taking to small claims court. You would have to pay it first, preferablty under protest - and then file. You would also have to show that you tried in writing to get the HOA to forgive it - the SC officer will ask.

Hi:My condo association charged me interest on top of late fees, then sent my accont to an attorney. The attorney charged me $200 to send me a letter; and the assocation charged me $200 for "turning the matter over to an attorney. All this because when I changed banks; the bank made the mistakss and even sent a letter indicating this. By the time all this was done, I had to pay $1500 due to 2 months late. They increase fees every year. They put in new windows (which cost $2500) and because cannot pay at once charge me $40 for 10 years! Also, they will not pay for plumbing; central air/ heat if anything breaks down. I was told that anything on the "outside" of the walls they would pay (air conditioning is outside), etc

My HOA charges $0.15 per $1.00 as late fees after 10 days. They also charge late fees on late fees. Is this rate nof 15% per month 180 % per year legal in NYS?

how much can an attorney charge for collecting past due maintenance fees?

I'm being charged $250 for the demand letter and to be set up on a four month pay plan the charge is $100 dollars a month for four months for Attorneys fees plus the normal maintenance fee of $216.00. I think this is outrageous but i don't know if its correct. Thank you for your help

Our HOA lawyer charges us nothing and collects his fees from the delinquent owner.

As to the late fee look up the florida statutes on line. I believe that it states the hoa can only charge you a late fee if their docs say they can. Something has to be done about these outrageous fees these associations are charging way out of line.
