Secondhand smoke in condo association common areas

  
  
  
  
  

I live in a two-story condo building. We have condo owners that smoke (and that's ok), but the smoke seeps into the common areas from around their unit entry doors. 

Secondhand smoke builds up all day long and into the evening as this is the primary time when smokers smoke. Cooking smells also get very strong. The condo association board has not responded to my concerns or suggestions to rid of the smoke.

My State Department of Health has no jurisdiction in this matter because a condominium association complex is considered a private residential entity. All 16 of us who live in the building are exposed to secondhand smoke in the corridors (including the smokers!) 

What can our condo association do about this?

Our board bought air fresheners to be used in the common area closest to the smokers units. This has mildly helped. Just be sure to offer to clean or buy replacement filters as a way to show responsibility of said solution. My $.02.

The Board and the management company representative must make a real effort to get 75% of your unit owners to amend your Master Deed. The admemdment should be written by the association attorney and every one that wants to be designated a smoking unit can. When thoes who want to be a smoking unit sell their unit is no longer a smoking unit. That is #1. I belive in any state you could suggest that the unit owner install a filtering process in the smoking unit. #2 Going to a smoke free association will NOT hurt the value of the units, no matter what you are told. #3
