Can we ban renters from our homeowner association?

  
  
  
  
  
Can our HOA stop rental units in our little comunity of 100 Villas?  Renters do not comply with HOA rules. They are loud and leave messes.  Can our HOA board pass a law to ban renters in our communnity?  How do we do this?

According to the bylaws of our association, it is the owner's responsibility to inform the renter of the rules and regs in the by-laws. If the renters are in noncompliance, the Board can go after the owner with fines-as stated in the by-laws. Also, be thankful the place is rented, or the existing co-owners are responsible for the shortfall in monthly dues.

Yes, but it is not easy. here in Florida you need 75% owners' approval to change the by-laws. 
 
Our condo did it 15 years ago and there is a big push to revert that change, but those willing to allow renters will find it extremely difficult to get the required 75% to make another change.

The rental regulations should be in your By-laws. By-laws can typically be changed by a majority owner vote - in accordance with the voting structure stipulated in your Master Deed/Articles.

I wonder what the Condo Association will do if someone decides to rent to a person who doesn't meet the age barrier. Here it's 55+ and the renter is her 40's. She's quiet so shouldn't set up any problems but wonder what could happen in case others object

Most States have asopted very similar ondominium Axts. This body of state law supercedes provisions of condo by laws. Typically it requires either a 66.67% or 75% affirmative vote of the unit of council owners to change a by law or adopt a new by law.Check to see if your state has adopted such a law and then get copy and read it.
