Are condo unit owners required to keep homeowners insurance?

Are condo unit owners required to keep their own homeowners insurance? Our neighbor above us does not have homeowners insurance and we are having leaking issues that she cannot pay for and has no insurance to cover the damage. What can we do about this?

Comments

At least in Massachusetts, unit owners are typically not required to purchase insurance and many do not. That does not mean that the unit wner is not required to fix the source of the leak if it originates in the unit and it does not mean that the unit owner is not responsible for damage below IF the unit owner was negligent. It is possible that the unit owner who sustained the damage would be covered by his or her own H)-6 policy and it is also possible tat the master policy might cover the damage above the deductible.
