Does power of attorney of a condo unit allow the tenant to be on the condo association board?

In most of the associations we collect for, no, that would not be permitted. The owner can give the tenant a proxy to vote for them, but that proxy does not extend to serving in the capacity as a board member.

It depends on what your documents state. If your documents state that it must be an owner in good standing (one current on fees is usually what that means) then it is specifically restricted to an owner. 
 
If it states that it may be the owner or their agent (someone they choose to represent them and their interests) or some other similar language, then they would be allowed to serve. I had a community where the mother of the owner served on the board. The mother did not own the unit, but she was the agent of the owners (daughter and son-in-law) and this issue came up. The Association's legal counsel pointed out this language and said that she could serve on the board. Most people were fine with it because she had an interest in protecting her families investment. 
 
You may need to consult an attorney as well, depending on the laws of your state.

I have an issue with a Developer who has moved in as a tenant after selling all units 5 years ago. The association has not been active, meaning all the owners have been on their own because we were unaware of the condo association, now he thinks he can run things, but he is just an tenant and wants to represent a co-owner who was be absent since I have bought my condo..
