Condo Association budget doesn't include salt for ice this winter

  
  
  
  
  
Can the Condo Association board of directors take salt out of the budget? Our Condo Declarations says we are to get plowed and salted after 2 inches of snow. Year after year it gets worse they are not plowing common areas sidewalks, driveways, parking lot and private street. They plow once and then thats it. Even if it continues to snow for hours after they plowed and they apply no salt. Can they bate their duty and promise in the contract because they feel legals for assesments out weigh the importance of salting everytime it snows. Everything is covered in ice! It's no secret they announced it at a condo association board meeting and we still have no budget for 2010 we have a condo association proposed budget.

If your declarations say it - then it is written in stone and the Board must comply or be in violation of the Covenants. Now, realism applied and the need to have funds available to pay for these requirements mean that workable and inventive solutions are needed. As a homeowner, what solutions can you create that might contribute to the solution of the problem?

I am a condo owner as well,in NH! The property mgmt comp/imposed on the board not having to take care of 2 MEANS OF EGRESS, per bldg...very, very similar to your issue! MEANS OF EGRESS IS THE KEY WORD! Call your State or local Fire Marshall! They WILL take em down and remedy the situation in a moments's notice! It doesn't matter if it's the board's word or prop mgt company..They have absolutely violated the bylaws! 
 
In additon, feel free to contact the attrny general of your state OR contact the BBB of your state. 
 
THE LAW IS ON YOUR SIDE!!! It truly is ALL About SNOW, ICE, SLIPERY CONDITIONS AND if someone falls, it IS THEIR HIT! IF an ambulance does NOT have access to a person in distress, again, IT IS their hit! PLS CALL the FIRE MARSHALL to complain!

Thank you so much! I will be all over it. Unfortunatley we had some warm days this week here in Chicago and the ice melted off the street and driveways. Next big snow I am CALLING! The city will be at my house today as well. The board is complaining about my upgrades and parital basement. I uncovered a HUGE can of worms last feb when I demanded a inspection. My husband and I were in process of finsihing the basement and found we had MAJOR water inflitration. Several coade violations and the association only fixed part of the problem on the exterior only never offered to fix or pay for the repairs inside. This past summer the basement flooded again and I have 3k in damage in the basement. They will not acknowledge or respond to my request for another exterior inspection. I am sure it would do no good as the board presidents son is the association contractor and he could not find the problem on the right side of the basement causing the flooding. The assessor is going to put on public record today there is a MAJOR problem with my unit and they will be lowering my assessments because of it. The board hired a attorney to go after the the city becasue we were assessed way too high. Its up for review this week. They are coming to my house in 2 hours to inspect and I am worried about disclosure and selling my unit in the future. This really sucks. I have lived here for 2 years in april and its been non stop BS from the get go! Any further advise is a appreciated. I ahve court with the association again next week on seperate issue. They have been refusing my assessments and cam after me for non payment... I got a lawyer I am taking them down! The said thing is the community will be stuck with my legal bill and now the boards over 351! We are living a nightmare! I have a small child in the house with life threating allergies to mold. We bought here becasue we needed new construction with no mold. I now have mold in my basement... I don't know what to do. I am sure we will have to move in the next 24 months due to the water inflitration in the basement my sons health comes first!

Dear Amanda..several issues going on here: 
 
1. lack of means of egress also involves if a fire ensues and people cannot escape! 
 
2.It may be possible, as in my bylaws, that interior damage is not covered by the board EXCEPT if the problem occurs from the outside affecting the interior of the condo. We have had many water 
 
ceiling leaks from outside snow dams, including mold issues in the interior. (I am exremely allergic to mold as well)and FOUGHT HARD, including calling FEMA! The board finally took care of it! IF you can prove the problem existed from outside condo faults,I'd nail them, especially with the mold issue! That iS a hot topic now days! Check your bylaws..contact Attny General, consumer complaints and definately contact BBB in your area and complain! 
 
 
 
2.) In addition, I believe it is a conflict of interest for son of board member to be evaluating said problem. I would DEMAND that an independent person check out this problem.  
 
 
 
In addition, I would contact your baby's pedia doc and have him write a letter to you and cc: to board! Keep ALL communications and docs..even one's to BBB..the more ammo, the better!

It's interesting what we Condo Owners have in common.. I am some how comforted with the thought that I am not the only one going threw, what I consider to be odd ridiculous issues. Our builder had defect insurance and we are still with in the statue of limitations.. There was one claim already on the decks ledger boards threw the association. It does not take a genuis BOARD OF DIRECTORS to read threw the complaints and have ALL issues addressed and do everything at the same time. The only people who benifit from doing things this way are the courts and the attorneys. Thanks again Melinda:) I really sppreciate it....

Dear Amanda..how are you faring? I have to admit, some consider me to be a 'para-legal', (which I'm not) w/ condo issues! I just nailed the prop mgmt co. and board for another by-law violation! I'm on the agenda for the upcoming board meeting..I knew they had violated the bylaws w/ this issue, but to make sure was able to get a free consult with an attorney who absolutely confirmed the violation! Don't let the board or property mgmt co. try to intimidate you or b.s. you BECAUSE THEY WILL! They don't want to pay for ANY expenses! Pls get the most recent copy of your bylaw/owner docs, etc book..THEY HAVE TO PROVIDE YOU WITH ONE AND AT NO CHARGE!! Sink your teeth into it and into them!! Question every word from that book! then document, document, document..I go under the radar, so to speak, I KNOW THE ANSWER before I ask the question to them! HA! If you ever have a question, ask me..not sure if there is some way I can send you my email addy..I'll try to find a way..and keep you posted.
