No one left to enforce condo association by-laws. What to do?

  
  
  
  
  
Where do condo owners turn when their property management company does not enforce condo association by-laws or address condo owners that do not abide by the by-laws? So far, attorney consultations and local police department has not made an impact.

I'm sure other will have a more defined reason but I thought that even if you had a management company your board should still be enforcing rules.

This is specifically a board issue. The reason you hire a mgt company is to do certain portions of the boards work, but when the mgt company drops the ball its the board that must take back their job. They should also fire the mgt company because that is totally unacceptable.

Do you know what the management company contract required that they do? Often, the management contract says that violation notices are sent at the discretion of the Board. Meaning that the management company cannot send violations on their own. Check out your association's contract with the management company before assuming they are at fault.

Is the job of the Board of Directors to enforce the By-Laws with the assistant of the Association manager (if applicable), remember the governing entity is the Board of Directors, if the BOD's instruct the manager to enforce the rules and he/her does not do it then you need to take another actions.

You may be misplacing blame on the manager.  
 
It is management's responsibility to enforce the rules, regulations and policies promulgated by the Board. 
 
The management cannot enforce rules on its own. 
 
I suggest you contact the board in writing with your concerns and see their response. 
 
My bet would be that it is actually your board not interested in enforcing the bylaws and rules. 
 
If that is the case and majority of the community are in your corner, elect a new board who shares the same views as the majority.

and i agree with the concept, yet i say WHY YOU GOTTA HAVE ABUNCHA FOLKS DOIN' STUFF ANY YOU CAN DO ON YOUR OWN AND NOT HAVE'AH BUNCH'AH HOODLUMS BE DOIN' IT FOR YA JUST TA LINE THEIR POCKETS? 
 
get a copy of your budget and tell me if there ain't ONE thing you ain't capable of doin' on your own without a buncha overpaid babysitters and a few extra headaches. 
 
now thassah "fa real" observation waitin' to happen.

You have a lot of correct responses. Mostly your board hires the management company. You need to take it up with the board if they are useless you need to call a special meeting to either get rid of the board or the management company or both.

What can owner do if the BOD and management enforce rules but selectively? I have lived in a 4 building 48 unit condominium for 9 years. The management sent violation letters to 2 building or 24 units but not the others-is this legal?

My board of directors for Meridian at Secret Lake Condo. Assocociation in Kissimmee Florida is also the owner of the management company Vision One Hospitality.  
 
 
 
Is this legal. Vision One took all the rental money and gave to the condo association.
