Can condo association board make vendor deals without approval?

  
  
  
  
  
Our condo building of 3 yrs old (48 units) needs all the windows replaced. The condo association board accepted a offer from the developer, they have also picked the new windows and entered a contract for replacement. All this was handled without a Condo Association meeting or review of any sort. Does the board have the proper power to handle all settlements and contracts without any owners input or reviews? Thanks

Your Documents will describe the Board's scope of authority. Generally, the Board is authorized to act as it see fit in situations as you describe. It is hard to imagine windows needing replacement in only three years. I suggest knowing your documents. Stay involved in your Association, Good Luck.....

I agree with Jeff. this is squarely in the scope of what a board is designed to do. Sometimes I've seen boards have "informational" meetings for owner's input but it's not a necessity. If you have an issue with the board's selection, ask them to seek a few additional bids. Better yet, volunteer to solicit some bids from local window companies to help the board out. That way you'll know if the builder's bid is in line with the market.

Sometimes, as in getting bids, it's best to hear it 3 times. Most likely, yes. Your association board was elected to handle the affairs of the association without informing the general ownership. However, having informational meetings is a great idea. Also, if you want to keep up with what is happening, read your monthly minutes to know what your elected officials are working on or go to the Board meetings and observe.

Hi, we have an unusual situation where our Board has allowed Verizo/FIOS to be installed with out a vote...we have 254 holes in our building and now find out that it has to be removed due to fire violations. It appaears they did not have to inform us the unit owners, however, if they had maybe a collective look would have prevented this. I agree with the above writter, informal meetings is a good way to go. I think this represents a model of of a newer, more modern Board which I think cold go far to solve many of these problems. In our situation, we feel that 254 holes represents a structure change and we should of been notified, what do you think? Also we have an extenuating circumstance, the Board Pres is a Verizon executive, but also there appears to be no expense involved, Verizon is paying for everything, never the less, this could of been avoided.
