What are your HOA/condo rules for parking spaces in garages?

  
  
  
  
  

Does anyone have any rules and regulations for renting out garages in a HOA? We have eight extra garages. One of the owners had her boyfriend living with her. She rented a garage for his Corvette. They broke up. He moved out. She moved out of state and is now renting out her condo. His car still remains in the rental garage basically in storage. In other words, we have become an unlicensed storage business. We don't have rental leases - should we? I live in a winter climate. We have a lot of cars in the parking lot because when the property was built, owners primarily had one car. Now we have a lot of two-car owners and renters. It is a pleasurable thing to be able to have your car in a garage so it starts when it is 20 degrees below and so you don't have to scrape ice and snow every time you go somewhere. Plus it gets cars out of the lot for when the snow plow comes. For rental garage rules, what do you think?

  • If an owner is not using his/her own garage for vehicle storage but is using it to store stuff, should that owner be allowed to rent a garage? 
  • We are getting more and more renters. Should renters be allowed to rent a garage or should owners get priority?
  • Should owners be required to use the rental garage for a vehicle rather than for stuff or snowmobiles or motorcycles?  Should owners be allowed to store vehicles and/or stuff for their family and friends?
  • Should absentee owners who rent out their condos be allowed to rent a garage? 
  • If an owner rents a garage and moves off the property, should they have to give up the rental garage? 
  • Should there be a waiting list for rental garages? We used to do it by seniority. Availability was posted, and the owner who had lived in the association the longest got it.

You don't mention if your parking spaces are deeded to owners or your building simply has general parking. This will have a significant impact on what you can do.  
 
 
 
Our rules are that an owner who wants to rent his/her parking space may only rent to another resident of the building. Our spaces are deeded and numbered. You must park in your space or your car will be towed.

The reason a user of an indoor parking space in a condo must be a resident in the building is a matter of security. Should you allow unit owner to rent to non residents you put the Condo at risk because you have no idea if that car is properly licensed and insured. Further you do not have the identity of the driver. Most condominium bylaws throughout the country prohibit such renting. Further if you have exausted all attemps to identify the driver I suggest you have it towed. If the olwner ever tujrns up you can provide him info as to where his car is stored. The storage fee will probably be more than the car is worth!

I am the original poster. To clarify: We have two buildings across from each other with sixteen units in each. Each condo has one garage space. We have eight extra garage spaces that we can rent. Our parking lot is in the center of the two buildings. The spaces are striped, of course, and anyone can park any where. We have four garage structures with about 10 - 12 stalls in each. The structures are stand-alone - not connected to the dwellings. Charles, that is an excellent point you had about security and especially so because our garage stalls are all open across the top, and any one can get into any one else's garage using a ladder. Yipes! My stall is in this same structure as is my car and my garage contents! I am not sure if Minnesota has any laws about garage renting, but I can look it up.
