Condo association common areas - who is responsible for floors?

  
  
  
  
  

Just curious. Is your condo association responsible for keeping up deck flooring? Mine will paint the railings and paint the walls but not re-stain and water-seal the wooden planks. Our bylaws are a bit fuzzy on this limited common element area. The ground floor condos have cement patios that do not need any upkeep.

Our CC&Rs are very much the same as yours. i.e. the Association takes care of the rails and walls but will NOT waterproof the deck itself.

Mine state they will take care of railings and if cement and it cracks and needs replaced then it is on me. 
 
As for wooden patios I would think it would be the same, don't exactly know that answer. Some assoc. state that if it is the same as your inside flooring (meaning cement) they will then replace it. But if it is separte from the inside flooring then you are responsible for the up keep.

Shat does your bylaws say about limited commion arteas?? Also check your state condominium act.

If the deck is for the exclusive use of the unit owner then it is a limited common element and the unit owner is responsible for repair and upkeep. At least it's that way in Illinois.
