Condo association wants obnoxious "For Rent" sign removed by owner

  
  
  
  
  

I am a board member of our small condo association and we have a owner that still has not removed their obnoxious "for rent" sign. It is in the by-laws and they know it. Any suggestions on how to deal with this?

1 - Write a letter refering to the by-law or rule that has been broken. Give a date to comply. 
 
 
 
2 - If situation has not been rectified, start the fines.

You have to follow your documents violation procedure if this is a violation in your bylaws. If you don't follow the process, you set yourself up for problems.

Prior comments are correct . However, before proceeding make sure your intended action does not violate your state condominium law. That law3 takes precedence over bylaws in case of conflict.

Everybody says follow the by-laws and the rules, the declaration says this and the declaration says that. Well what good are these rules if people don't follow them. 
 
I am gonna stop reading this site 
 
for nobody has any good comments as to what to really do. I am going to start living and following what everyone else does, and that is NOTHING.

I do believe our condo rules state we can hang one sign in our window, but only for a certain lenght of time and we can also post in our front but tastefully. 
 
Any other signs is prohibited. This is U.S.A. What is your objection to this sign anyways?

The first three comments are good advise. I am a board member as well, and giving a written warning siting the bylaw and regulations, and a date to comply and outlining the process of non-compliance regarding fine assessment is sufficient. The Bylaw should already comply with any state laws if they were done correctly. if they do not comply, start the fines. $$$ usually gets their attention. Good luck.

Send warning letter. If it is on condo property, remove the sign. Change bylaws to dictate size, color, location of display; as long as it does not violate State law.  
 
As for the person saying they'll follow the crowd? Well, if the Board was assertive about educating the ignorant, and aggressive pursuing violators, then all of you could end up in court. Passive boards do not protect property values. You should RECALL THAT BOARD! This is not the time in real estate to be passive about property values.

In these tough economic times, if an owner can not sell and is trying desperately to hang on, renting may be the only option short of foreclosure. If a sign can stop a foreclosure, petty rules should not interefere.  
 
If the unit becomes vacant and in foreclosure, there goes the HOA dues. Use some common sense and have a heart. That is the trouble with condos, a bunch of narrow self righteous petty individuals trying to rule others' lives. 
 
 
 
 
 
I for one wish I had never bought into a condo which I can not unload.

In response to condo hater, it sounds like you are very upset by this question, these are 2 million dollar beach condo's and the owner is not losing the property. A question was simply asked on how to deal with this. Because you made a bad investment don't hate on others. Some good sex will help you with all of that built up anger! Thanks to everyone else!

To Condo Hater, if that were the case, then the owner could try being an adult and going to the Board with a special request. However, that would then open up the Pandora's Box for everyone else, would it not? Special treatment for one? The rules are established because there is a reason, the signs actually bring down property values. If I am looking to buy and I see all these rent/sale signs, I am going question and think twice about the community. We have a board in our on-site office where people can post. In fact, it behooves the owner in that they can post the details of the property.

I own in a former million dollar plus complex, ocean front that is now worth about half of what it wass. We have had 2 foreclosures and the owners destroyed the property they were losing causing damage to ajoining units with water damage caused by frozen pipes. The banks took many months to foreclose and we lost fees. Just because it is a high end property, do not think you are immune. Foreclosures bring down values a lot faster than signs.
