Condo association and reallocation of percentage interests

  
  
  
  
  

I live in condo in PA. WE have 2 bedroom that pays 95$ in HOA fees and 3 bedroom that pays $115. I just found out from HOA bylaws that we have 45/55% reallocation of percentage interest. That means it should be $95 for 2 bedroom and $133 for 3 bedroom. I asked the president of our condo to change it but she refuses because she already send a note to homeowners that they not going to increase condo fee for 2011. Can you tell me what I can do about it? Can I ask for my money back for years that we paid a wrong HOA? (HOA was arbitrary and never took account for the size difference). Thanks.

usually no change of interests can be made without a vote of 2/3rds of the unit owners agreeing to changes.This is in our condo agreement and I believe consisent with Conn law

You should download and read the Pa condominium act. I don't understand your post. You indicate you are paying less on your 3 bedroom unit than the allocation interest would otherwise provide.I don't folllow your logic that you have a claim for a refund. Please explain further

For us it was more fixing a mistake, even though it's increase for 3 bdr. My point was that when she send a note to homeowners that there is no fee increase, they didn't know about wrong fee. Since they do now, they can't continue overcharging us.

That's exactly right. 3bdr pay less than they have to, because our association never followed bylaw percentage of interest. I recently looked into that, and made calculations and found out that our condo fee was wrong from day one. That's why I contacted ouu president of association and asked her for change.

They have to raise the hoa fee now. 
 
Maybe assessment. 
 
If you have 3 bedroom ,YOU OWE them.

We have our association attorney, I am not sure anymore if she(attorney) represents homeowners interest or the association? Should I get another lawyer? Should association cover that fee? Also, association had special assesment for roof replacement recently. And, again, it wasn't followed by bylaws percentage interest. And 3bdr received more money, even though they never pay enough toward HOA. That's why I was asking if I can get my overpayment fee back? Thank you for all you responses.

Mr Leisureville thinks that a crime might have been been committed and want to file a lawsuit. Is it possible that a mistake was made?  
Let it go. At the next meeting insist that the mistake be rectified going forward.

It's all started in May. WE had 2 meetings after that. I told them couple times on meetings. Then I wrote 2 pages report with all calculations and copy from bylows on percentage interest. Then I talk to president and still nothing been done. That's why i posted a question here thinking that somebody may have simular problem. I don't think the board memers did it purposely, they probably didn't understand what percentage interest really means and how it needs to be implemented. What bothers me the fact that they don't want to listen and make a change, even though the president finally admits that I am right.
