Does condo association gain voting rights when taking unit deed?

  
  
  
  
  

We are a Florida condo association.  When the condo association takes deed to a unit, does this allow the board to count this unit when a membership quorum is needed? Does it also give the board the ability to submit a limited proxy towards voting for items related to budget items such as: Rollovers, waiving financial reporting, and fully funding or waiving fully funding reserves?

In FL, the new condo laws that came into effect in 2008 state that no unit that has been taken over by the association can be used in any voting procedures or used to constitute a quorum. Call the Ombudsman's office in Tallahassee, they are very helpful.

Does the State of Maryland have an Ombudsman Office for such matters.

Yes-There are a group of ombundsmen in the Attorney Generals Office. But there are two counties in Maryland, Montgomery and Prince Georges who have Consumer Protection Offices of their own.The Attorney General's Office routinely refers consumer complaints they recieve to these commissions when the complaint is for actions in those counties. I've dealt with the Montogomery County Consumer Protection Office and fine them responsive, very knowledgeable and in general very effective in resolving disputes brought to their attention.

In the state of Florida When a budget is prepared and approved by a condominium's Board is it not true that a CPA must sign that budget regardless of the amount of Income that the Condo receives. Our Condo's BY LAWS states that it must be signed by a CPA. Is there a paragraph in the Charter 718 that states it as well?
