What State? Your Governing Documents should cover this. You do not say if the offical proxy was completed and attached to the e-mail or whether the member merely sent an e-mail. If the latter I would not be surprised if the proxy was not completed correctly in accordance with Statute and the Governing Documents

I doubt that email voting is covered in your bylaws or state law. Until it is I would say that it's much better to require the out of state member to mail in their voted ballot. Not being present at the meeting does not mean you must name a proxy to vote for you. The out of state member should be able to mail their ballot to the property mgr.

The Condo Association is in FLA.(sorry I usually add that to my post) Our doc's are 30 years old. They don't address email. The Proxy was not attached to the email. The email was in a standard letter form basically just requesting that their email be used in replace of thier proxy. Just to make it clearer, this was a limited proxy for budget questions. 
 
In addition to the original question, After reviewing the proxy's I have found that many were filled out wrong, not signed in the proper spot and other various errors, would this be considered just a technicality issue or could the proxies be void because of issues like this.
