Why should I pay repair bill for condo association's shoddy work?

  
  
  
  
  

My condo unit sustained wall damage and rot due to faulty initial construction work and faulty repairs on recent tile work (exposed wall outlet with no caulk). Every time it rains, water comes in at the wall seams. Now the condo association wants me to pay for some repairs - such as finish/paint. Why would I have to pay if the damage was due to their error. Thanks for your time.

You need to examine your bylaws, responsibility grid matrix if you have one. If the issue is caused from an association covered issue the paint repair cost should be included. Provided that you timely reported the issue. 
 
 
 
If you failed to promptly report the issue and interior was damaged beyond reasonable time frame, you should pay for the paint. 
 
 
 
I would write a letter to the association explaining the reason you feel the paint should be covered, because this is an association covered area that has caused damage to your wall. 
 
 
 
Check your bylaws carefully. Most association do not cover interior damage to the unit or the furnishings.  
 
 
 
Remember, to be nice to the board of directors, you will go farther being nice they trying to fight a small issue. 
 
I am sure they would expect that if 
 
they were in the same situation they would expect the association to cover the expense to restore it.

I'm not being smart, but the reason you will be held responsible by the contractor is that you are an owner of the corporation. In nearly every state, the owners of the coroporation are responsible for its bills. Just saying "I didn't authorize it" or "I didn't know about it" usually doesn't fly in court if you are an owner. The judge will typically say that it is your obligation to know about and manage it since it's your corporation.

I know this is hard to hear, but when you live in a condo, you pretty much live in a 'communist' community. Everyone is responsible for everything. And if something is done to just your unit, affecting the inside of your unit, unfortunately, you are responsible. What I do if the Association is going to work on my unit is to ensure I am there when the work is done, and stop the person when I see that it's not being done correctly. I make the worker accountable. In the future, if something like this happens, do not let the Association repair your unit...have it done yourself and at least you have control over the cost. Sorry, but condo living has its trade-offs. Being fair is not one of them.

If as you indicate the problem is caused by faulty construction find out from your board what they are doing about forcing the developer to pay to fix?? If the developer is long gone then, in the fault is contruction problems in a common area the association bears tyhe repair cost incl;uding any collateral damage inside units.

Linda and Nana -you are both wriong. The situations that make life difficuolt in a condominium or HOA are apathy and ignorance. Apathy in that unit ownerts do not get actively involved and that leads the board members to develop into dictators. If you read you by laws and then take adction at every violation by the board life can be very nice. Come rent a unit in my condo and learn how we live.
