Can we tow condo owners for using handicap parking spaces?

  
  
  
  
  
We are a condo association with three high-rises, 210 units. We have limited, posted guest parking only including two handicapped spaces per building. We have two owners that have taken over the guest handicapped spots for their personal use. They both have garages closer than these spaces to their units. They have threatened to sue if we tow. They have also agreed to use their garages when they purchased and our bylaws reflect the same. Can we tow?

If they are parked in a handicap space, simply call the police and report them. They should send someone out to ticket them and that's not a cheap fine. That way there is no need for towing.

Iy they are not "guests" you may have them towed. If they are not handicapped call police to ticket them before towing them.

Caution here! If these persons are handicapped, they will have certain rights under the ADA laws. They may, for health reasons, be within their rights; or they may petition the Board to provide a more convenient space as a result of their disability. If they are not handicapped and simply ignore the law, call the police and let them deal with the situation. Don't tow or you may be held responsible for any fines or damages.

First and Foremost, make sure your parking rules are clear, if the handicap parking is for "guest handicapped" clearly state that. Mail out the towing guidelines and that the towing company will issue a warning and document abuse. Many already have website that photograph and upload to internet the proof. Leave enforcement to them, they will make random tours of the property and tow according to guidelines. That way they violators are dealing with people who are use to towing vehicles and co-operate with police.  
 
Many have threaten to sue me, none ever have, illegally parked is illegally parked, pictures prove everything, even their lawyers tell them to behave and they have no grounds to sue.  
 
Issue clear guidelines, certify your mailing, and let the towing company enforce.

If you know these people are not handicapped then I say tow them or leave a warning sticker that tells them when their car will be towed. Who cares if they threaten a lawsuit? Make sure local law will back you up but don't let a bunch of losers bully you and take away parking spaces from those who truly deserve them. I have been on a condo board for over 5 years now and take no nonsense from those who fee entitled!
