Mold is killing unit owner. Condo association won't repair it. Rights?

What can I do about the mold under my condo unit. I've been fighting the condo association for 12 years about this and I have run a sump pump everyday. They say there going to fix but never have. I think I'm having health issues as a result. Can someone Please tell me what my rights are. Thank you, Branden.

Contact the county health department to first determine if you have an issue. then work with the hygenist if it needs repairs.

12 years is a long time. What exactly have you done to make the association fix the mold? Please be specific.

In St. Louis our County Health Department told me there was absolutely nothing they could do. They sent me back to the city and they cited the Board for "standing water" which was a code violation. This worked extremely well but we are still working on the cleanup issues two years later. We just had a meeting with the risk management man from our master insurance policy. We needed to pull someone else in who had "knowledge" and "authority" as the previous two boards ignored the owners. Of course, it's not covered, but what we "uncovered" is that when the building was built 20+ years ago, there was some type of settlement between the original owners/association and the builder. Three current owners knew about it and this information was never brought up to new owners but slipped out the other day when we asked if we could submit issues to the insurance company. Good luck. We will follow your posts very closely. Our association is refusing to fix the "mold" issues, but once the drywall was removed to vix the water issues - it became a code violation again that we have no drywall is certain locations that "buys time" in case of a fire. Again, without the drywall and knowledge that it must be put back in - we don't know if we would even be insured if there was a fire. We are working hard to remedy this and have a new Board President who is a man - and we think people will listen to him.

Definitely start with the Board of Health and they will come out and examine it and if there is a health problem they usually will find a solution and make the association do something about it. There is also a Housing Authority run by the state government that may help.

First, you need to find out what is causing the mold. Mold needs moisture to grow and a substrate to grow on. The most common is drywall. If there is no moisture, mold can not grow. I've seen cases of pigeons getting in an eve and mold grew on the feces. The solution was to cover up the hole, remove the feces, chemically clean everything and add ventilation. Long process but the problem is solved. The most common reason for mold in Chicago right now is builders built on the cheap. They used split face block to build(cinder block), no one ever seals it and water absorbs like a sponge. This carries over to the drywall and mold grows. I would identify where the moisture is coming from, review the docs and see who's responsible for that area (faulty window, brick, etc.) the last thing I would do is call the health department. Mold abatement is very costly and if you force the issue that route, it may cost you money in the long run. A little more info and some pictures and I can help you at no cost. since 2004 we had one meeting, I pay my fees every month, but the Condo Ass. dont due a sing. The frame of my padio door is bent, the Condo Ass sucessd me to call my insurance and report a burglary............

12 years is to long to have to fight this. Call a TV station and have them do a piece on the issue. You'll get results.

I have a test that tested positive for mold. The association won't do a thing about it. I calle the health dept and they said because I am an owner they can't do anything. If I was a renter they could go after Landlord. Lost in CT??

I live in a condo community where my 300 building and the 100 building have standing water and mold. We have tried to work with the developer and his wife, who are President and Vice President of the HOA, to correct these problems with no success. We homeowners found out in October of 2012 along with the management company of our HOA that none of the crawlspaces were waterproofed during the renovation (these used to be apartments). Twice during the six 
years I have lived there, I have had raw sewage which took months for the Board (the developer and his wife) to approve work to be done to correct it. I have called TV stations, tried to hire an attorney on a contingency basis, contacted every govenment official with no luck at all. I am at a total loss as to how this developer can get away with this and nothing can be done. 
What can I do?!! Please help.
