Condo association conflict of interest with management company?

  
  
  
  
  
Conflict of interest? Our former management company (a one-person company) is also an owner in our FL condo development. She is also an employee of our present management company, at a different condo development. She may run for the Board. Does this sound like a conflict of interest?

In my opinion it seems like a conflict of interest because if and when the board sits down to talk about the management company for a future contract the owner has ties to this company.

It most likely is a conflict of interest. Check your by-laws. Ours strictly prohibts such business relationship between board members, vendors, etc...

Seems to me that as a owner she is eligible to stand fot the Board unless the DCCRs say otherwise.A conflict of interest may arise in which case the person concerned should note vote. It might be useful to have such a person on the Board

well, FL state says she can run simply because she's an owner. not happy about that.

Our association has had that very issue. After we replaced the individual as a managment company she as an owner comes to the board meetings and tells the new company how to operate their business. The management company or its employees should not be board members as it is a conflict.

Watch out for this trick. 
 
My board says that if the other board members know about the conflict, then there is no conflict. Put another way, if the majority doesnt have a problem with it, then there is no problem.

the interesting thing is...less than a month prior, at a BoD mtg the BoD said they no longer wanted to do business w/ owners who had businesses (i.e., cleaning). So, in that light, I have challenged them on this issue. We're tired of the cronynism.

SHE HAS NO HEAT IN ONE ROOM THE OWNER DID'T PUT IN THE WARRANTY ABOUT THE NOW THIRTEEN YEARS LATER 
 
SHE WANTS THE ASSOCIATION TO PAY 
 
FOR ALL THE REPAIRS AND THERE ARE THREE OTHER UNITS UNDER HER THAT THE PLUMMER MIGHT HAVE TO TO THRU THOSE UNITS WHO SHOULD BE RESPONSIBLE FOR THAT BILL

If the board knows about the so called conflict of interest and they are ok with it, then it isnt a conflict. 
Meaning that if one board member is a crook and the other members dont object , the crook wins. 
This can happen easily when the wrong people keep getting elected to the board.

If a condo board's attorney is also the condo management company's attorney, is that a conflict of interest for the attorney?

If a condominium association board's attorney is also an individual condominium association member's attorney, is that a conflict of interest for the attorney (the association board also representing the association member)?
