Multiple condo owner never sets up association, gets charged by state

  
  
  
  
  
I purchased 6 townhouses all together - one small building about 6 years ago. I never formed an association because I owned all properties and were using them as rentals. When I purchased the properties no one told me you had to go to department of business and professional regulation of Florida condos, timeshares and mobile homes and pay a fee. I have never been notified by them till today. They sent me a bill for the last 5 years plus penalties because they said I owned all 6 I still have to pay. Why wouldn't they send me a bill originally.  I had no idea.  I already pay them - a  hotels and restaurants a fee because if you have more then 4 properties together you have to pay that fee. I mean seriously..I call them up today because this is the first time I am hearing about this and the rude lady said I should of known and tough they can't waive any fees and it's not their responsibility to notify me? How is an owner suppose to know when there is no association as I own the whole building. By the way..those are the rudest people I have ever spoken to.

The Association was setup before you purchased, i.e., when the condo docs for your "6 townhouses" were recorded. When you purchased, your deed should describe the property. You should also have known it was a condo because of the circular / propspectus for offering that all new developments are required to provide. 
 
Even though they were operated by you the majority owner, you were required to operate them in accordance with the laws of the state of flordia. That means that you probably haven't had the yearly budget meeting, held an election (although that would be moot), and done all the other things an association is required to do each year. Claim of ignorance is not a defense. 
 
Every year you were required to file not only a corporate doc for about $62.50, but you also were required to pay the DBPR it's $4 per unit I believe.

State employees rude? Quite rare. Did you provoke them by asking questions?

I am guessing you did not chose to use an Attorney for your purchase of the 6 units. If you did, it should have been discovered. The Dept you are dealing with has been nothing less than totally professional and kind with me regarding complaint resolution with our condo, you must have provoked them. I am not an Attorney, nor like them, but you should have used one, if you did, you used the wrong one and are now paying the price for trying to save a few bucks. Pay the piper and move on, ignorance with the state is no excuse. They are blood suckers!
