Condo association secretary wont cooperate in board takeover

  
  
  
  
  
We have organized a unit owners meeting to remove several board members. We have limited proxies for this particular vote, since the secretary refuses to cooperate; do the unit owners who organized the meeting submit the proxies?

You must read the condo or HOA documents and your States "Statutes" on the "recall" subject. It outlines the procedure. In my state once the required amount of owner signitures is met and submitted to the Board, they have a certain period of time in which to respond and hold a meeting to address the recall. The Board cannot refuse to respond.

You have the proxies, you have the members,you don't need the  
secretary. Hold the meeting, after the requisite time passes.  
Recall who you need to recall; elect new officers; make sure that you recall the secretary who wouldn't cooperate.

See if your state law provides for exact procedure to remove a directors or secretary of the board.

I live in a condominium and the place where i live has an association that has gone far to far with rising cost increases and other non sense thru out the years.At present time many homeowners have gone into struggle mode with higher that affordable association dues rising over $425 with a non gated community.Many neighbors are either foreclosing and or in short sales because of this circumstances of economy and layoffs in Florida.I want to rise up and find a way to force the association to lower the cost of the association costs per month for the entire community but I need to know where to start and the process.Enough is enough and my association bard members are jerks to begin with with to much power and word has it that some do not apy the association because theya re on the board as well
