Condo association trash can removal rules are impractical

  
  
  
  
  
Our condo complex provides that each unit has its own trash can, which is put out on the trash collection day (Monday). When I moved in, there were no additional rules related to the trash cans. Since then, the board made a rule that trash cans had to be returned to your garage by 10 am on Wednesday morning. Tonight, there was a new notice posted that it's now 10 am Tuesday morning. That's all fine and good for the retired people that are home all day. I have a job though and frequently work out of town (often not making it home at night). It seems a little ridiculous to fine me for being out of town for a night and not being able to put my garbage can back in my garage. I'm trying to figure out whether I have any grounds to fight them on, or whether it's simply a case of "If I want to change it, run for the board."

I'd explain your work situation to the Board. Perhaps if they knew you were not always home and able to put the bin away they would be more understanding. 
 
10AM they next day does seem a bit quick, our HOA rule is two days later and we ask folks to contact us w/ your exact situation. The by-law should not be meant to penalize those that are already cooperating.

I'm sure you support the Board in their desire not to have unsightly trash cans lying about. If you are away and cannot get a neighbor to take the trash can in, advise the Board that you suppport the rule but, as you are sometimes away, on occasions you may not be able to comply. I would be surprised if they did not make allowances.

I agree with "Point of View", if you speak to the Board President, explain your situation and ask for their assistance or understanding, I'm sure they'd try to find a way to resolve your dilemma.

I live in a rather large community where the homes are very close.We have the same rule and believe me there is a reason for it.We sometimes have so many trash cans laying in the street or on the sidewalks that it looks aweful.People coming to visit always remark about how bad it looks.Some people care about how it looks while others don`t. We have also had problems with the wind hurling these cans into parked or oncoming cars causing damage and lawsuits.Severe storms can make missles out of these cans causing damage to windows or even siding.For your own good I would find someone that can fill in for you when you are not around.

Their rules are supposed to be REASONABLE. . .  
 
If I were you, I'd get a petition together with signitures of as many "working" residents as you can - and submit it to the Board with demands for them to remove this rediculous rule....

On second thought. . . they are giving you until the next day. Certainly everyone should be able to bring their cans in by then. . . So in my opinion, it isn't an unreasonable demand afterall. . .

attend a board meeting and ask the members why it has been changed as they may have had problems  
 
even if you do work you should have a few minutes to take in the garbage can the next day---it helps with the appearance of your community 
 
if you are out of town, call the management company and explain your situatuion and notify them when you will be bringing your garbage can into the garage 
 
a board cannot please every homeowner so be understanding and work with them the best you can
