Who is responsible for utilities in condo association?

  
  
  
  
  
I sold my condo 2 years ago to the other owner in the house (I owned 1/3, he owned 2/3 of the house, now he owns the whole house (and condo association). Recently, the town put in new water meters and gave him a bill for past water due (apparently the old water meters were not working and now the condo association has been charged for the difference). He wants me to pay 1/3 of this bill from when I lived there. I don't feel that I am responsible as I sold 2 years ago. Who is right?

Legally, I have no idea. What I do know is that when I sold my first townhouse seven years ago, I sold it free and clear and would never expect to have someone come to me for any portion of a community related bill that was adjusted two years later - especially since I would have had no control over the meters. In my opinion, if the meters hadn't been working (and the town is responsible for them), the town should have replaced them a long time ago. If the owners are responsible for the meters, then perhaps you should pay your share. You may need to ask an attorney.

I think it is totally un-ethical for a utillity to be allowed to charge owners of a property 'after-the-fact' for underpaying because of THEIR faulty meters! They should be sued in a class action procedure (imo).

If he has to pay for past undercharges then you should have to pay too, for the time you also owned the property.... 
 
 
 
As I said earlier, gather the other owners together for a "class-action" law suit against the utility AND contact your politicians and news media....

--as a condo association you have a board of directors ---how have they addressed this issue with the town regarding meters not working properly for two years 
 
there is more power for the association to contact the association attorney for legal advice on this  
 
i do not think you are responsible for anything associated with the condo you sold two years ago as you left in good faitH---YOU DO not mention the amount of money involved for you or the owner to pay as legal fees could amount to so much more ---unless the current owner specified guaranteed of payments in your sale contract to cover problems like this, i think he needs to pay---again it would be good for the board to contact the association attorney for the community

I would not pay a bill from 2 years ago. The new owner should go after the town. It is ridiculous for them to charge the owners after for the towns screw up.  
 
If the water meters were defective how did they come up with what ever amount you owe? Tell the town your not paying especially since the meters were defective.

It seems likely that you do not have any legal obligation to pay these water bills if no lein or anything like that was referenced in the title work at transfer or in the REPC (purchase contract) at your sale. Morally & Ethically you may feel it is appropriate to pay your share just to do the right thing. I would just be certain the current owner provides all the back up documentation as to how they derived the amounts they seek from you and that you are comfortable with the calculations.

We bought 12 unit individually from the owner who converted it from a rental bldg. to a condo --- six 2 bedroom & six three bedroom ---To sell the condo's he had all the maintenance 's set at $237,00 a month --as they were being sold being new owners no-one wanted to rock the boat --so when we got raises we all went along with it ---there are also 12 boat slips -which 4 are being used --with electric bill being shared by everyone in regard to the common areas -I do not think this is fair because 8 of us do not have a boat --- --recently they raised the maintenance & decided to have a reserve -10% of what we have in the bank which they claimed it is now the law -qustionable -I would like to hear from -about mainternance 7 electric bill for docks --I am thanking you advance for this information --Joan Lapi
