Condo association wants to remove tree in courtyard. Can I fight it?

  
  
  
  
  
I live in a small condo with a lovely courtyard. I'm responsible for the maintenance within my courtyard and there is a large beautiful tree growing there. I've been 'informed' that the tree has been slated to be removed. I don't want the tree removed, it not only adds aesthetic value, but since my condo is all windows allows for shade for myself and many other residents. Do I have recourse? Thank you in advance for your consideration.

Did you talk to the board or call the property manager?

I assume the courtyard is common area. Thus bthe maintenance of this area is the responsibility of the condominium association. Have you inquired as to your boards reason for wanting to remove the tree, Perhaps it is diseased or operhaps the roots are causeing problem to undergraound utility lines. You may find there is a validf reason for the boards action.

Trees are usually removed for a reason. They arent cheap to take down. 
Too bad they didnt bother to tell you the reason.

They told us that the roots are causing damage. They are not, with the exception of a sidewalk that looks a little crooked. 
 
The idea that they would take a 2 story tree out of my private courtyard, really bothers me.  
 
In the City of Tempe where I live they have lost over 400 trees since 2008 because of monsoon and other natural events.

There are many arborist and botanical orgizations that will side with you. It is certain that they know how to bring in the City and the ENVIROMENTALIST. They will have to move the underground utilities before the Enviromentalist and the goverment will let them cut down that tree.

I've contacted the Garden Assoc. of Tempe and the city. I've received great interest from the city which amazed me until I looked up some things about the people and their efforts. 
 
I'm going to fight this with everything I can, and really appreciate any ideas anyone has!  
 
The City of Tempe has responded, its just a matter of getting the right peoples attention. 
 
But I will chain myself to the darn thing if I have to. LOL

I am not suprised that the board did not send a letter out to all in the courtyard about removal of the tree. If it is causing a sidewalk to buckle or soon will. You would not want a law suit for someone falling or tripping over a sidewalk that is not level. Most developers plant too big of trees and the wrong type that grow too close to homes, utilities, fences, sidewalks and driveways with their roots growing around or under the above mentioned. Could they plant a tree that the roots grow straight down? A law suit is worse then not having shade...
