Why does our condo resort have different assessment rates?

  
  
  
  
  

I own land and a park model trailer in a condo resort park in Seneca, Illinois. There are 6 levels of association fees. All the lot sizes are the same at approx. 5000 sq ft.  The county taxes are the same for each lot at approx. $197.00. Our electric, water and sewers are included in the assessment. The 6 categories range from $674.00 to $1218.00 per year. We can't get a answer why the difference except that that is what was setup years ago. There isn't any difference in the land or location in the park. Is this OK for the association board to charge 6 different categories for association fees?

If it is in your declaration of condominium it is legal. If not and there is no amendment stipulating this; then no it is not.

Could this not be the same reason higher floors are deemed to have a higher owner percentage than a lower floor even if the square footage is the same? Perhaps one lot is closer to the lake or other amenities, more privacy...to blanketly say that the lot sizes are the same is just a portion of the total picture.

It has been my experience that assessments may vary based on size and value of the condo.

The original developers must have had reasons...You may be able to figure it out by closely and carefully reading your documents. CAn any of the original developers be reached? Warning, if you want to have a conversation with one of those original developers be friendly--not confrontational.

Refer to your state condominium law for clarification. I think you shall find that cindominium fees are based upon the square footage of each unit which then defines the percentage ownership for that owner in the council of unit owners. The size of the plot is irrelevant to this calculation.
