Should owners sue townhome association for car damage?

  
  
  
  
  

Can I sue the Townhome Association for not repairing my carport? My carport was damaged during Hurricane Ike (9/08); a large tree fell on the carport and the Association removed half of my carport. It hasn't been repaired, as a result mine and my son's vehicles have rust and sun damage.

Who is responsible for maintaining the car port? This should be specified in your DCCR's. 
If it is the Association's responsibity to maintain it what action did you take to ensure it was repaired? e.g. did you write to the Board? If not why have you waited so long to raise this? 
What action did you take to protect your cars, a responsible person would have taken reasonable action to protect their property 
If you took resonable steps AND it was the Association's responsiblity to maintain you may have a case taking action however, I would suggest you try and resolve the matter amicably rather than rushing to legal action.

It's been a long time since IKE. I'm suprised you didn't check your documents or speak to your Association Board. I also presume there have been 1 or more property managers since 2008. I would think the courts would ask the same questions. The most important is "WHERE HAVE YOU BEEN" since 2008? Perhaps it's time to take responsibility for your lack of action. Get the carport and your cars repaired. A legal action is not the solution for everything. Remember this is ALL your personal property. You do have a responsibility to do the right thing.

If you've followed all the advice above and can't resolve it, try mediation versus a law suite. Suing the association is really a lawsuit against yourself.

Need help please....... 
i have a water leak on my garage when it rains and i know for sure that the HOA is responsible for the repairs, i have talked to the board of directors i have send them letters, also have done it with the HOA and i have sent them certified letters and pictures and i get no response, Now if HOA doesnt answer me what should be my next step? 
i have tought of going thru my HOA insurance and raising a claim, is that the proper way? or should i go to court?
