Condo board wont recognize new owners group in meeting mintues

  
  
  
  
  
We started an Owners Group at our Florida condo complex. Since March, when a different Board Member became Secretary, he stopped listing the names of the owners present at Board Meetings. The prior Secretary did list them. Now they're telling us there's no law they have to. This is their way of shutting us out, not wanting owners to know we're there each month. What can we do?

If you board uses Roberts Rules in cionducting their meeting their action is not permitted. Roberts requires names of oawners attenduing to be l;isted in minutes.

First thing to do is look in your bylaws. It's shameful how a lot of boards think they are rulers of the realm and try not to work with the other owners. It's a simple and right thing to add the owners name.  
 
So what is going on that you had to form a new owners group?

I disagree with the statement that listing owners present at Board meetings is required by Roberts Rules. What is required at Board meetings is that Board members present be listed. At meetings of the Association owners must be listed. This is to demonstrate that a quorum was established so that business can be conducted.

Even if it was a requirement of RRO, if your bylaws do not state RRO must be used, then that is a moot point. I doubt it is a requirement of your bylaws to list the names of all members present at a board meeting. We have a professional minute taker taking the minutes of our board meetings and she only states a member present if that member has a complaint to air before the board. I think your Owners Group is on the defensive over nothing! Omitting the names of the group members is hardly "shutting" down the group! It sounds to me like this "group" has issues with the board and will look for anything to call them down. Group members -- get a life!

FS718 - The Board shall allow owners the right to speak on any agenda items and should establish rules to do so. The Board Meetings only require that Board Members be listed and solely from the legal aspect of establishing a quorum. 
 
Member are required to sign in at Member meetings and may be listed in those meetings if desired but not required. 
 
We manage close to 100 communities. Owners are never listed in minutes and seldom even have a sign in sheet at a board meeting.

If during a boad meeting there is a vote of the assembladge and names are not recorded how does the chair know who was authorized to vote and how does that count get recorded accurately??? If a owner offers a motion and it is seconded how is the vote on that motion recorded??

Only board members are authorized to vote at board meetings. Same with motions; only board members are authorized to make motions at a board meeting. 
 
Even at a member meeting, the names of the members present are not recorded in the minutes. A sign-in sheet is used to record the names of the members present and to establish a quorum. But, the topic here is a board meeting.

@Vic...we started the Owners Group due to maintenance fees way too high in comparision to like communities nearby, not to mention our selling prices one third of theirs. We formed the group to attend all BOD Mtgs, review records, and publish a newsletter, have a welcome wagon, and communities events/parties/crime watch. 
 
@Mary...The shut-out is more than this issue...we were not allowed to speak at last BOD Mtg due to time constraints of Mgmt Co., yet we discovered FL Statues allows owners to speak on agenda items. Not to shabby for having a life, no?

Fighting a board is always difficult. You basically have little recourse because the states don't like to get involved For starters how many units are there? How many are rentals? 
You should ask the management for a copy of the yearly audit and if possible you have to try and get audits from the past years. Did you get a copy of the yearly budget? If not then ask for that also.

@Victor...only 43 units, 5 are rented. I will do exactly that...ask for the audit although I remember seeing in minutes a reference to an audit and being less than 50 units. got the budget, it makes no sense and we're working on that. have reviewed payables for last 5 mos. we're starting to watch where the money goes and from i can see, our fees can be reduced by 10%, even while allowing for reserves to build.
