Can condo association board auction of unit owned by trust?

  
  
  
  
  
Can a Condo Association's Board of Directors auction off a unit that is owned in trust. An attorney for senior citizen in a nursing home, purchased her unit. Somehow, Board is now trying to auction this unit and is taking bids. Is this illegal?

If you want the correct answer ask an attorney specializing in real-estate law. All you're going to get here is opinion. 
You have a lot of contradictory statements. If it's owned in trust why does an attorney own it? Is he selling it for the trustee? Is the HOA acting as his agent? How does it affect you?

OUR HOA BOARD REFUSES TO HAVE A RESERVE STUDY DONE FOR OUR CONDO 
 
BUT STILL PUTING FUNDS IN RESERVE  
 
FUNDS WHAT CAN WE DO WE HAVE ASKED THE BOARD TO PLEASE HAVE A RESERVE STUDY. OUR DOCUMENTS SAY WE HAVE TO HAVE A RESERVE STUDY. CAROLYN

Carolyn, what are you trying to ask? You say the board won't do a study on "our condo". Reserve studies are for the entire development, not just an individual condo. If your bylaws state that there must be a period reserve study done then make sure the board is having a qualified reserve study done by an outside agency. We have ours done once every two years. The board reviews the study and submits recommendations and changes before the final study is done. The association absolutely needs a study to know how to manage it's reserves and how much to assess in monthly dues. Talk to a lawyer if this is not being done as it will affect the value of your property.
