My condo association is harassing me, what can I do about it?

  
  
  
  
  

I’m interested in finding out how to deal with a condo association that has waged a campaign of harassment against me for the last 6 years. This all started a few months after the condo was purchased in 2005 and after a major rain storm my unit had water intrusion in 3 rooms. At the time the developer was on the board and responsibility had not been fully turned over to the owners. I spent a few months trying to work out the details of the repair with the developer but was getting nowhere. By this time the condo owners had taken over the board but the developer was still on the board as our treasurer. I wrote numerous letters to the “new” board providing all of the details of my situation and explaining that I had attempted to work with the developer but was not getting anywhere. I paid out of pocket for my own assessment of the damage including mold remediation and at that point had been living in my dining room which was not affect ed by the water intrusion. At this point, those that decided to become board members had become “buddies” with the developer as he had not alerted them to the water intrusion problem or that I had contacted him about the problem. I asked the board to investigate the issue because it was an outside common wall that allowed the water to enter my unit. I immediately received negative pushback from all but one of the board members and the developer. I heard excuses ranging from the fact that it was not their responsibility because it was not a common wall issue and even told that I should not have purchased a ground level patio unit if I didn’t expect to get some water occasionally. I hired an attorney and started proceedings to sue the developer as well as the board. Eventually, I was able to get my unit fixed without having to go to court but it still cost me thousands in legal fees. I also sent letters to the board stating that it was a conflict of interest to have the developer on the board and that I did not think that they has done their fiduciary duty in assessing the health of the building before taking over control from the developer. Had they done so, this problem would have been found out immediately, as the building had only been occupied for 2 or 3 months prior to the water intrusion and the full responsibility would have fallen on the shoulders of the developer. The board did not retain its own attorney to review legal documents or have an inspection done at the behest of the “I’m your friend” developer. Ultimately, the developer had to dig a 6 foot deep trench down the side of the building and put in all new drainage piping, water p roofing membrane, appropriately grade the grounds and install a sump pump. A month later I received a noise complaint from one of the board members. (I had been living there for 3 months with no problem up until I started proceedings to sue them. I was fined $25 for the complaint. I was then sent a letter that I could no longer have my grill because it was a fire code violation. The reason why I purchased that unit was because it had a patio large enough to allow a grill based on DC fire code laws. I spent the next few months fighting the board about the grill at which point, on a fourth of July, one of the board members called the fire department to my unit 3 times. Each time the Fire Marshall said that I was within the required distance and up to code. The board, being unsuccessful in making a case for DC fire codes, eventually tried to make it an insurance issue and failed and finally changed the Rules and Regulations to not allow the storage of Charcoal or Propane on the premises which successfully ended my being able to grill because I receive d a $25/day fine for everyday that the grill was stored or in use. Also, before the water incident, I was told that it would not be a problem to have a second small dog. I purchased the dog from a breeder in Florida and flew down to get her. It was not officially changed in the Bylaws that owners could now have more than one pet and I didn’t worry about it because we were all getting along. After the water problem, I was told that I was in violation of the Bylaws and fined $25/day for everyday that I had the second dog. I eventually was able to find her a good home with a relative but incurred huge fines because I was not willing to just give her up. These are just some of the issues that I have had since attempting to protect my home, my health and my investment. Since 2005 I have received no less than 50 complaints and well over three thousand dollars in fines for various “complaints” for everything from noise violations, not even being able to have a friend visi t with a pet because that would “constitute me having more than one pet in my home”, having the police called at two in the afternoon because I was having a party on my patio, and yes the police said I was within my right but I was still fined by the board. One of the members even entered my unit without my permission when my door was left open to harass me about a form that they wanted. I have since moved out of the unit and now just rent it out because I was tired of the constant issues with the board and feeling like a prisoner in my own home. Now, even with me gone, they harass my tenants to the point that no one stays more than a year and I still constantly receive fines or my tenants complain about being harassed. I am at my wits end with this and need guidance. There was another unit that had water damage and he was actually on the board. He was out voted and out gunned and eventually harassed so much that he and his wife sold their unit and moved. They even mad e it hard for him to sell his unit. Also, to add to this problem is that I am the only remaining African American person in the building as the other person (a renter in a developer unit who was given a unit due to DC’s tenant rights law was run out as well. This board has shown a history of do it our way or get out whether we are right or wrong, and the ring leader of the group is the same person who has now forced two people to leave their homes. I refuse to be a victim of harassment, racial bias (multiple witnesses available to corroborate this fact) or just plain ignorance.

Sorry, for all the pain & mess you have gone through. You need to bring in bigger guns, something that will not cost you personally anymore money. Have you tried the news? NCCAP? For your own piece of mind sell and have a better life. Sadly this happens everywhere everyday to many people. It doesn't matter who or where you are. Give some people a little power and they go crazy- Look at history. The opposite is true too, boards that do nothing because it is too much trouble. Our condos have suffered under both kinds of boards. Both are equally bad.

first-seperate the water issue from the cpmplaints/fines. with respect to the water issue, get an attorney. 
 
 
 
next- quit living on the edge, comply with the condo docs. and be a good neighbor. get rid of the grill, and if you dont want to give up the dog ( for example ) expect the "nasty-grams" and fines to continue. and yes....i am a board member of my condo. assn. and frankly, i am taking the liberty of making the assumption that you are not exactly an innocent victem.

In situations such as these, you have to ask yourself is it worth the fight? How much of your life and sanity are you willing to give up to "win", and what really will you win? Say for instance, you do win a lawsuit against them....do you really think the harassment will stop? 
 
Perhaps you should look at how to break away from it entirely. Approach the board and/or other members of the community and see if anyone is interested in purchasing your unit for fair market value. If they want you gone bad enough, they'll find a buyer or band together to buy your unit. If they can't afford it, put the unit up for sale. If they don't want you there they are certainly not going to discourage the sale especially when doing so would affect the value of their units as well.

Well, I think you need to consult with an attorney again. Your complaints sound very legitimate to me. For one thing, you (your attorney) can fight the Board at its own meetings about fines. The attorney must review your condo docs to make sure the Board has been following the procedures and rules of the docs. If not, you've got a real case.  
 
About an action in court: you may have a civil rights case - I can't tell; maybe NAACP or similar group into fair housing/discrimination could provide initial guidance 
 
before you incur costs.  
 
A few things- statute of limitations. In CT there's a 6 year S of L for contract actions (condominium documents are treated legally like contracts between the parties: unit owners, a developer (the "declarant")and the Association) and all the parties have implied duties not to injure the rights of others under the condo documents (called a "covenant/implied duty of good faith and fair dealing"). The DC condo laws also may have such obligations per statute. 
 
Other types of wrongs are likely to have maybe a three year S of L. 
 
You're still the unit owner so you have the standing to go after the Association (represented by the Board. 
 
In CT when condo laws are violated and the case goes to court, whoever wins is entitled to atty fees. I'm sure your earlier lawyer discussed the pros and cons of settling that case without providing for your full recoupment of monies spent for the lawyer's services. 
 
I guess my bottom line of advice is for you to learn more about your legal avenues and in doing so to draw your lines in the sand on the battlefield you choose and over issues you believe you can win. 
 
Generally, your tenants should of course document every problem with the Association/board/other owners. Names, dates, times, pictures notices any anything in writing should be saved and show the sequence of activities. Any stuff you already have may be useful in a "continuing course of conduct" allegation you may make. 
 
I'm glad you're speaking out, and I wish you the best in your fight for justice and peace. I recently read a bit of history on Wikopedia about Fred Shuttlesworth, who just died and was from Birmingham, in the days when the Klan and the cops were pretty much the same entity. You'll draw inspiration there. Knowing how you can win the fights you choose is a key. And with respect to choosing fights: understanding the condo docs and other applicable laws (DC condo law specifically because state law MAY explicitly trump condo docs when there's a conflict) as to proper procedures the Board (and you) must follow, as well as the substantive rights the parties (a unit owner; the Board; a developer) have or do not have are all an important part of making the fight.

Condo 101 Homework for future Condo Buyers. Read all documents and verify and check BBB, Health of HOA Funding, etc. Do due diligence to make an informed decision prior to a purchase. 
 
You are so emotionally (and financially) invested, but after reading THE ENTIRE COMMENT, it seems: 
1. You are h@ll bent on this battle, 
2. You HAVE been wronged and have not sued for damages, 
3. You no longer live there, 
4. You DO understand BIGOTRY AND PREJUDICE, 
5. You need to decide if you want to continue in the drama or just sell the unit, 
6. Weigh the WELLNESS factor of this issue (mental and financial) vs. "DUKING" IT OUT. You can choose to be a martyr, or not.

Sell. I understand that you are probably African-American, so the injustice you feel is palpable. But you are IN BUSINESS with people who you say are targeting you for no reason. You've sued them, so now they REALLY are not happy with you. Not sure if "justice" is worth this. I also think you may need to examine your own conduct in the exchanges with your Board - while I'm sure you feel wronged, there may have been situations you could have handled differently. 
 
Get OUT of business with the people you say hate you. Take your money and what you have left of your dignity and GTFO.

My first impulse is to tell you to leave.  
 
But, if you have unlimited funds, and enjoy the drama, I would document every instance of harassment,(and you seem very capable of proper documentation.)  
 
You must carefully read your docs and make sure that you are in exact compliance with every rule and regulation.  
 
Then make sure that the harassers know that you mean business and are willing to out-spend the entire Association. Make sure that every Member of the Association knows what you are doing and the monetary limits that you are will to expend; and that every time that you drag the Association into court the other members will have expenses.  
 
Your letter is quite detailed, but you don't say how many Members (owners) there are. The Members of the Association (owners) who are not on the Board will resent the unnecessary expense that they are being forced to lay out--but they must understand that you are without fault.  
 
You can be sure that your enemies on the Board have poisoned as many people as they can against you. You will have to wage a public relations campaign of your own to get everyone on your side.  
 
If you really have the money hire a PR firm to get your point of view over to the other Association Members.  
 
The Board is bullying you. Make sure that you obtain an attorney competent in Condo/HOA affairs. He (or she) must be fully sympathetic with your position.  
 
Then, when you have all your ducks in order: stick it to the bullying harassers. They deserve it.

We want to point out that we agree with Sally Santiago that you seem very good at writing your complaint and documenting. But please put paragraphs in your writing. Separate your points with paragraphs. It's hard to follow.  
 
Good very luck to you in your fight. You are really being taken to the woodshed. and that isn't pleasant.  
 
Not only speak to lawyers, but too, you should speak to a few real estate brokers who may have ideas about "quiet enjoyment" of your home. This is a legal concept that might fit your situation. After you understand it ask your lawyer about it. It may be another ground for your suit against these despicable people.  
 
Of luck, we wish you the best. In our barbershop in Brooklyn on graham avenue we always had friendly relations with all neighbors and it was a pleasure. Even in the olden bad days when we slept in the back of the shop the neighbors were fine. But in Florida, where everyone is retired people are more like you describe--nasty. Why? We don't know.

Sometimes you are left with no recourse but to sue. Other owners must have similar complaints against the board. See if any will join you.p in a suit. Selling now in a down market would not be wise. Besides that, would you want to hand off the problem to an unsuspecting buyer? Try to get it resolved first. You'll sleep better in the long run.

I really appreciate the advice that everyone has offered with regard to my post. Please forgive me for the horrible formatting snafu. I believe that it must have happened when I copied the text to the website.  
 
I have thought about selling for a few years now, but with the market the way that it is, I would barely break even. Also, I just feel like no one should be forced from their home (albeit I already moved out and am renting it) due to the actions and personal feelings of others, especially when doing so could cost you tens of thousands of dollars.  
 
My condo is in a very good location and there are only 20 units in the entire building. I thought that purchasing in a small building was a good thing because it would offer a sense of community and you would actually know your neighbors and everyone would be friends. What I didn’t take into account is the fact that within small groups of people, usually even smaller groups “clicks” of people are established. With this board, it is not so much about following the rules or right and wrong, it’s about who has the power and what they believe. It has become a system where personal feelings and opinions get in the way of actual business. I can tell you the exact date when things changed, because as I said before, I was living there for months without a problem and everyone was neighborly. It wasn’t until I started calling people out on what was right and wrong (with regard to the water intrusion and the developer being on the board) that things became different. Just to make it clear to some, I am not at all attempting to pull the race card. I do, however, believe that there are still people in the world who are highly offended that I would even begin to imply that not only are they wrong, but then prove that they were wrong and make them correct their mistake.  
 
Again, I appreciate all of the advice and I will be sure post my updates if anyone is interested in knowing what happens.

Brian, your comment is spoken like a true board member. You sir, are an example of exactly what is wrong with condo boards.  
First, the water issue was taken care of because I had to almost sue the developer and the board. The reason why things were finally fixed is because they HAD TO FIX IT because they would not have won in court.  
Second, How is being comfortable in my home “living on the edge”? Who said that I wasn’t a good neighbor? For instance, the neighbor above me has carpet on the entire floor. He comes down to my unit for the fourth time in maybe two weeks about my music level. I finally decide to go up and listen for myself. I could barely hear the faint thump of the song, but then I realized that he had the football game on and it was muted. Well low and behold when I take mute off you couldn’t hear anything at all except for his TV. So was he being overly sensitive to noise when his own television was muted? Did I mention that this person is on the board and that this is the same person who complained about me having a gathering on a Saturday afternoon? Did I also mention that the neighbors on either side of me have never complained? Well, one complained about my dog barking like crazy once but that was an easy fix. 
Did you miss the part about the fact that the condo Rules and Regulations were CHANGED to suit the needs of the board, such as having my grill (reason why I bought the unit) for months with no problem up until I threatened to sue? It just so happened to be the same board member above me that complained about the grill. Did you miss the part where I stated that they did not have a leg to stand on legally so they CHANGED the rules? Did you miss the part about how I flew to Florida to get a dog that I was told I could have but after threatening to sue I was then told I could not have the dog months after the dog had been there? I especially like your part about not exactly being an “innocent victim”. If protecting my health, the health of my wife and not having a brand new condo which floods is indicative of me not exactly being innocent, then stamp me guilty. I was taught that you should never make assumptions. There is a reason why there is a saying about those that assume. You make and ass out of you and some guy named Ume.

I am so sorry for the issues this man has had to face. I do beleive someday more illegal actions must be developed towards board members that out right harrass owners to fullfill their need of power. 
 
Knowing that this owner is black, I do feel it is totally racisit 
 
action being taken upon him. 
 
 
 
Example: Like the Rep Politicians & Tea Party working to OUT a Black President.  
 
 
 
Laws should be made to FINE Board Members by a Lawyer when it is so evident by the actions shown here. I would SUE them all and sell my unit. If it doesn't sell, RENT it but you did win. 
 
The other people here making comments to pay your dues and do what they want is BULLSHIT. Similar but less of the type of harrassment I went through here in my condo. I paid for test when they said there was MOLD. Most people here dislike our Board and they KISS their BUTTs. Villas I doesn't want any union with us, Villas II. 
 
Enough, but someday hopefully Laws will pass to better take care of POWER_HUNGRY OLD PEOPLE>

My husband and I also live in a Condo suburb and we have just about-completely paid it in full, and we too are the only African American homeowners (unbeknown to us upon purchase) that lives here. 
 
 
 
After settling in some 9 ½ years ago, we made every attempt to be good neighbors; we were previous board members; we set the community up to become independent of an outside Management company in order to become self-maintained by the board, and was later voted off with additional board members due to one older lady - a board member who boldly verbalized her strong disapproval of "educated black folks" as she puts it, referring to my husband and I.  
 
 
 
Since then I have had to stand my ground against crazy comments from other caucasians board members stating “if so-in-so (meaning another condo owner) does not stop breaking the rules we're going to have to get a water hose and some dogs and drag her out of her house.” Comments like that.  
 
 
 
And recently, or I should say over the course of two weeks and two months, I have sent several emails asking the board to send a repair-person to come and replace the storage room door which has bubbled up from last years Tennessee’s May 2010 flood, and fix the outside wall/panel before one of my children, my husband or myself gets injured. No one, absolutely no one has responded to my emails. 
 
 
 
I am not crying racism however, I am not understanding why we can not get any help when several of my neighbors all caucasians have received new doors and outside panel replacement. 
 
 
 
The president of the board continually states that previous board members did not conduct business for our section on a business level and that we are a corporation yet they (board) picking and choosing who they will and will not help. 
 
 
 
We pay-on time each mother 229.00 just like our neighbors yet we are treated in a very rude and disrespectful way 
 
when it comes to service. 
 
 
 
Can someone advise us. We have never lived in a condo suburb before.
