I live in a condominium in south Florida, when the president resigned, the new president nominated me as the new vice president. Three month later, do to sickness the new president resigned. As vice president my seat would have ended on Feb. 8 2012. Since I took over the president's seat, which would have expired on Feb. 8, 2013, do I have to be re-elected for presidency or keep my seat until Feb. 8 2013. thanks

Your bylaws should have a section or two in the Executive Board/Board of Directors portion entitled "Vacancies." As a board member/officer, it is important that you understand the bylaws.

Also, please check whether you're correct when you say "As vice president my seat would have ended on Feb. 8, 2012." In CT there are only directors' seats and there are not officers' "seats." Directors' terms of office are set by the bylaws. Officers, on the other hand are not voted on by unit owners, but are chosen by the board itself after a new director is elected by the owners at the annual meeting. (Although quite often, the officers remain the same because the same board member gets re-elected).

What I'm saying is that if you're up for re-election as a director on Feb 8, 2012, it makes no difference what office you hold. Again, in CT the directors are elected by unit owners at the annual meeting to serve generally 3 year terms (the terms originally were staggered so that each year one director slot expires and the owners chooses the same person/a new person to serve a 3 year term. one ). Officers, in contrast, are chosen by the board members themselves with no set terms of office after the yearly election. It sounds like you're up for re-election as a director on Feb 8, 2012.

According to FL law, you cannot be "placed" into a position when it is vacated. The law states that the board has to make do with whatever board members are remaining until the next annual meeting, when a vote will have to take place. Also, you can only stay on the board for 2 consecutive years and then you must step down - UNLESS - there are no other candidates running. At that point, you will be allowed to remain for another year. If you have people on your board who have been there for many years they are now required to step aside.

Can an uncooperate, board member who states she doesn't like or want to work with others on the board be removed? Also, is a letter sufficient?
