Can condo board revoke parking permits of delinquent owners?

  
  
  
  
  
Does the condo association board have the authority and the legal right to revoke designated parking spaces of homeowners who are in arrears in their common charges. To enforce a rule to tow and or boot their cars. The Condominum is located in New York.. All comments,opinions and legal input will be appreciated..

This is one you had better research thorough. Check you Docs and if you have a state Condo agency check with them. A slippery slope.

You should check with an attorney for your specific situation. In some condos parking spaces are deeded (meaning they belong to an owner) and in this case you can't tow. In other cases parking is considered common area and in that case you could tow, but you need to comply with all local laws and regulations associated with towing.

Yes! It is legal in the New Jersey. We have done it at our home association and been taken to court where we won the right to stop the use of common areas and also water and sewage.  
It gets the deadbeats attention and works!

We are considering towing the cars of people from their assigned spots who are not in good standing at our condo complex in New Jersey... 
It does get their attention.

Legal in New York State. The Voard jhas the fiduciary duty to insure collection of all monthly fees. As such they must take action to force the issue. This is one way which has proven most effective in the past

If you spent as much time paying your assessments as you do in trying to get out of it, you would put less burden on your neighbors who have to foot the bill for you.

We just started regulating parking in our association. In Ohio you can also regulate parking, most state condo acts give the association the authority to make and enforce compliance with rules to regulate parking on the property because it's necessary for basic operations. 
 
Regarding "Jim's" comment: I think they are simply stating the frustration felt when delinquent owners don't pay their fees and then burden owners who are current. Not being able to park gets their attention.

it looks like jim is assuming that the poster is the delinquent, could be that he is right ? also, in florida it is not legal to withhold access or parking permits to owners in arrears
