Getting our condo association recertified with FHA and HUD

We are trying to get recertified by HUD/FHA within our existing condo group. One of the requirements is providing a plot/site plan. Since we have been in existence since 1987, and were already approved (it lapsed last July without the knowledge of the Board of Trustees) Can we submit just the copy of the recorded Book/Page which we can get on line at the Registry, or do we have to submit the actual site plan of our condo?

Good for you for taking on this task! I did the recertification for our complex before it expired. If you mean a copy of the recorded plot plan, then yes, you may print that out and include it in your submission. Good luck!

I am trying to do a reverse mortgage. The association has to be FHA approved. I was told by a board member that we lost it a couple of years ago as the units need to be 50% owner occupied. Can someone tell me if that's true? This board member has lied to me several times. I live in NC if that helpd.

Yes, new FHA guidelines require that associations maintain at least 50% owner occupancy. Other restrictions include: 
 
All condominiums (consisting of 2 or more units) must meet the following requirements: 
• At least 50% of the units of a project must be owner-occupied or sold. 
• Projects must be covered by hazard and liability insurance and, when applicable, flood insurance. 
• No more than 15% of units can be in arrears of their condominium fees. 
• No more than 25% of the property’s total floor area in a project can be used for commercial purposes. 
• A current reserve study must be performed to assure that adequate funds are available for the funding of capital expenditures and maintenance. The regulations don’t define what is “adequate” but guidance may be found in the new Fannie Mae guidelines which mandate at least 10% of annual operating budget in reserves. 
• No more than 10% of the units may be owned by one investor. 
• Rights of first refusal are permitted unless they violate discriminatory conduct under the Fair Housing Act. 
• An affirmative action-type housing plan is required for both new construction and conversions. 
• Previously certified projects must re-apply every 2 years. 
• The “spot approval” process is eliminated in favor of a more comprehensive review process.

hello again! my question is: we've been owners of 2 condo units in a shopping plaza for over 15 years, water bill was included in associaton dues. now the anagement has decided to put individual water meters,all owners will be responsible for their bill. please comment on the issue,since when we bought the units ,it was part of the deal.thank you in advance, sincerly, vivianne

Things change in life, nothing is static, and the condo docs will tell you what the BOD can do. However, do understand, it is a Board decision, management cannot make such a decision.

It can be a hassle dealing with the HUD people -- it all depends on which HUD office you are working with. Keep really good notes of any phone calls/emails, whatever. We got everything together and then hired a real estate attorney to spearhead the final submission since we ran into so many different answers from HUD on our own. We are in the St. Charles/St. Louis, MO metro area and our HUD office is KC, but we were transferred to Philadelphia due to the high volume of FHA approval requests last year.
