I'm going through the beginning statges of the process right now. Research first before starting anything. For the protection of the members of the Association from lawsuit, you should probably form as a non-profit LLC and file as such with the feds and your state, or you can take your chances and file with your state as an unincorporated organization of owners. Every state (and some cities) has its own codes in reguards to unit ownership/condo associations. Research your state's codes. You may have to file as an association with several different agencies in your state such as the real estate commission and the state department. There will fees that need paying along the entire process.

I recommend you engage an attorney because of all the legal hurdles to forming a HOA.

Why did not the builder & /or convertor set up an assn? 
 
You really do need an attorney for this, lots of areas where you can make mistakes.
