Who covers cost of water damage: association or owner?


Question:

My question is about who is responsible for expenses related to water penetration into the home. This spring we had A LOT of rain. The ground was saturated and began pooling in the low area behind one of our 1st floor condo. Because the ground was saturated, water made its way under the foundation (20' away) and wicked up through the concrete soaking carpet in one room. When the carpet was pulled back to check the foundation there were no cracks found, just evidence of the water slowly coming through. Who should be responsible for taking up the carpet, getting it dried and put back down, the association or the owner. The owner feels the association should pay because the water came from outside. Should we consider this a foundation failure even though there were no cracks, or would it be considered an act of nature/GOD and the owner be responsible? Just 1 condo unit was affected and our documents do not address this situation. Help please.
