$200,000 not a capital expenditure?

This question is submitted by Carl P. out of Jensen Beach, FL. 

Our board of directors is attempting to spend approximately $200,000 to install a sheet piling sea wall on the creek along our property.  This creek, which has had RIP RAP for Erosion control since it was built in 1978, has never had any issues and it hasn't required a great deal of maintenance. Our BOD are tying to push this project under the umbrella of building maintenance to avoid a unit owner vote. I believe that this is a capital expenditure project and should require our vote, is that not a fact?
