Association needs to get into owners unit to rid of termites


Question:

I am on the board of a 9 member HOA. One owner is renting her condo out, is totally uncooperative. Termite was found in the building where her condo is in March  and we have since tried to get her to cooperate giving access to the pest control company and fill out their waivers. She has ignored this 3 times now and forced to cancel and reschedule. We solicited legal assistance from an attorney, who sent her letters and telling her the Board can get a locksmith to give us access or we can obtain a court order. She ignored this too. We don’t wish to take on liability in having a locksmith opening the condo and if there are renters in the condo the only way out is a court order. We cannot afford the expense of a court order even when she is ordered to repay us later. We already paid hundreds of dollars in legal fees that didn’t get us anywhere. Besides not cooperating on having the building fumigated, the same owner is renting the condo out for weeks at a time without notifying the board. This is in clear violation of the CC&Rs.
I sincerely hope you may have an advise on how to handle the situation.
