Builder runs new HOA board and makes  own rules


Question:

I recently purchased a townhouse that has an HOA. It currently sits with the builder of the 5 units, 3 of which have sold. The builder and his wife are the executive board, the president, vice president, secretary and treasurer. My question is, since a majority of the units are sold, when does the association transition to the unit owners and we can vote for our own officers? Right now the builder is making demands of the unit owners that are not reasonable, like you must keep your trash bin (town owned barrels, so they are all the same) in your garage and not right outside the garage. The 3 unit owners all agreed we didn't want to keep them in the garage, but the builder has threatened to assess a $25 per week per unit charge on anyone who keeps them outside their garage.
