Can condo board give up control of common areas?


Question:

Can a board sign a settlement that relinquishes the responsibility of common area to one unit owner for not paying dues? Governing documents only allow for 8% annum interest and nothing more. Documents and State laws state common area can not be divided and is the responsibility of the Association. Who would Insure the common area? How can the board give up responsibility? Any questions just ask and I'll try and post answers. I just believe this is fraud by the Insurance company lawyers. Ohio
