Can HOA turn my patio into common space?


Question:

Our condo (two story) has a front patio with a fence around it. The condo CCR docs clearly show the patio with its current dimensions as part of the condominium plan, and the language of the CCR is clear that the patio is part of the "unit" as shown on the plan.

There is a rumor that the HOA is wanting to claim the patio of myself, and our neighbors (with similar patios/fences as shown in CCR plan) as common areas, and/or to take down the fences themselves, which would remove all privacy from the patio space.

Would this be legal given the clear delineation in the CCR?
