Condo complex dealing with poor construction issues from 36 years ago


Question:

We live in a small condo complex of 18 buildings that were built in the 1980's when our Tennessee county had minimal code enforcement and inspection.  After 36 years construction flaws have reared their ugly head and a number of unit owners are threatening to sue the HOA for the faults and the consequences of poor construction. 

Others of us have maintained that we all had the opportunity to have professional inspections performed prior to purchase and should live with the flaws or elect to resolve the issues ourselves. Each unit has a foundation on grade and shares no overhead structure. 

Any thoughts on the issue?
