Do we have or need a property association?

Question:

I live in a neighborhood of nine homes with a private road. The road is deeded to the property owners association. There are no bylaws or articles of incorporation. I don't believe we have ever incorporated but in the past they had a bank account for maintenance. That was all closed years ago and fees are just collected as needed. My question is: Do we still have a property association? Can we "re-establish" and incorporate so we can build a reserve fund?
